I'll incorporate those changes into the Pineywoods Tote Co. Rental Terms & Conditions.

The updated agreement will specify a full refund for cancellations made at least 7 days in advance, a $20 replacement charge per missing or irreparably damaged tote, and your Lufkin mailing address.

For court costs and attorney's fees, I recommend using a clause that requires the customer to pay reasonable collection costs, court costs, and attorney's fees to the extent permitted by Texas law. This is stronger than an unconditional statement that they must pay everything, because courts determine which costs and fees can legally be awarded. It also accounts for small claims cases where you may represent yourself without an attorney.

## Rental Terms & Conditions

**Effective Date: October 15, 2026**

By reserving and renting moving totes from Pineywoods Tote Co., the customer agrees to the following terms and conditions.

### 1. Rental Period

Our standard rental period is 14 days, beginning on the scheduled delivery date. All totes must be returned at the end of the agreed rental period unless an extension has been approved.

Custom rental periods and packages may be available upon request.

### 2. Delivery & Pickup

Pineywoods Tote Co. provides FREE delivery and pickup within 50 miles of Lufkin, Texas.

Delivery and pickup dates must be scheduled and confirmed in advance. Customers must provide accurate addresses and ensure safe, reasonable access to the designated delivery and pickup locations.

Delivery and pickup outside our standard service area may be available by special arrangement and may incur additional charges.

### 3. Customer Responsibilities

Customers are responsible for:

- Packing, transporting, and unpacking their own belongings. - Using the totes for their intended purpose. - Keeping totes reasonably protected from damage, theft, and loss. - Returning all rented totes at the end of the rental period. - Ensuring all totes are completely empty, reasonably clean, and stacked together in one accessible location for pickup.

Pineywoods Tote Co. does not provide packing, loading, moving, unloading, or unpacking services.

### 4. Pickup Requirements

All totes must be completely empty, stacked together, and ready for collection at the scheduled pickup time.

A **$50 trash haul fee** will apply if totes contain belongings, trash, or packing materials when our team arrives for pickup.

Customers are responsible for removing all contents before collection.

### 5. Payment Terms

Full payment is required before delivery.

Reservations are subject to availability and confirmation. Customers remain responsible for any applicable additional charges, including rental extensions, missing or damaged totes, and other fees outlined in these terms.

### 6. Cancellation Policy

Customers who cancel at least **7 days before their scheduled delivery or pickup date will receive a full refund** of their reservation payment.

Cancellations made with less than 7 days' notice are non-refundable.

Cancellation requests must be communicated directly to Pineywoods Tote Co.

### 7. Rescheduling Policy

Customers may reschedule delivery or pickup with at least **5 days' notice** without penalty, subject to availability.

For rescheduling requests made with less than 5 days' notice:

- 50% of the original payment is forfeited. - The remaining 50% is applied as credit toward the rescheduled reservation. - Any additional balance for the new reservation must be paid before delivery.

All rescheduled dates are subject to availability.

### 8. Rental Extensions

Extensions must be requested before the scheduled pickup date and are subject to availability.

Additional rental charges may apply. Extensions are not guaranteed until confirmed by Pineywoods Tote Co.

### 9. Lost, Missing, or Damaged Totes

All rented totes remain the property of Pineywoods Tote Co.

Customers are responsible for returning the full number of rented totes in reasonably good condition, allowing for normal wear and tear.

A **$20 replacement fee per tote** will be charged for any tote that is missing, stolen, or damaged beyond repair.

Customers agree to pay applicable replacement charges upon receiving an invoice.

### 10. Prohibited Uses

Totes may not be used for hazardous materials, flammable liquids, illegal substances, or any purpose that creates unsafe conditions or causes excessive damage.

Customers may not sell, transfer ownership of, or permanently modify rented totes.

### 11. Personal Property & Liability

Customers are responsible for their own belongings throughout packing, transportation, storage, and unpacking.

Pineywoods Tote Co. does not take custody of or transport customers' packed belongings and is not responsible for damage resulting from improper packing, overloading, or handling by the customer or third parties.

Nothing in these terms excludes liability that cannot legally be excluded.

### 12. Ownership of Rental Equipment

All rental totes remain the property of Pineywoods Tote Co. throughout the rental period.

Payment for a rental does not transfer ownership of the totes to the customer.

### 13. Collection Costs, Attorney's Fees & Legal Proceedings

If a customer fails to pay amounts owed, fails to return rental equipment, or otherwise breaches this agreement, Pineywoods Tote Co. may pursue available legal remedies, including filing a claim in small claims court or another court of competent jurisdiction.

To the extent permitted by applicable Texas law, the customer agrees to reimburse Pineywoods Tote Co. for reasonable and necessary costs incurred in enforcing this agreement or collecting amounts owed due to the customer's breach, including:

- Reasonable attorney's fees. - Recoverable court filing fees and court costs. - Legally recoverable costs associated with collection and enforcement.

Such amounts are recoverable only to the extent authorized by applicable law and awarded or otherwise legally enforceable. Nothing in this provision guarantees an award of attorney's fees or other costs.

### 14. Governing Law & Venue

This agreement shall be governed by the laws of the State of Texas.

Any legal action arising from this agreement shall be brought in a court of competent jurisdiction in Angelina County, Texas, to the extent permitted by applicable law and venue requirements.

### 15. Changes to Rental Terms

Pineywoods Tote Co. may update these terms for future reservations. The terms accepted when a reservation is confirmed will govern that rental unless both parties agree otherwise.
